Legal advice

The first and most important step when purchasing a property in Spain, even before choosing the property you wish to purchase, is to engage a Lawyer to guide you throughout the procedure and start a Due Diligence process in order to ascertain whether the property is free of charges and encumbrances. Your lawyer will make all the necessary inquiries regarding the property at the Land Registry, Cadastral Office, Tax Office, Town Hall, and Banks.

NIE

The NIE (Número de Identidad de Extranjero) number in Spain is the tax identification number assigned to any foreign citizen to carry out procedures with the Spanish government. Therefore, if you are considering investing in Spain – for example, with the purchase of a property– the first step is to obtain the NIE number. This would be assigned to you by the Foreign Office. We can help with the application procedure for NIE if you need.

Rervation

The developer signs this document to take the property off the market. Typically, a minimum of 6.000 euros is paid upon signing this document.

PPC

This contract covers all the terms, conditions, and obligations of the purchase, such as the property sold and its annexes, the purchase price, the requirements and responsibilities for each party, terms and means of payments, date of completion, etc. Upon exchanging the private purchase contract, the buyer shall pay from 10% to 30% of the purchase price as confirmation of the reservation of the property.

Public Deed

You must sign the Purchase Title Deed before the Notary Public, pay the remaining purchase price, and hand over the keys and all documents related to the property—registration of the Title Deed at the Land Registry. The deed should be signed when the license of First Occupation from the town hall shall be granted.

Taxes

Depending on the type of property you are purchasing, we can distinguish between two situations for the taxes and expenses of buying a property: the first transmission and the second transmission or resale.

When purchasing a newly built property in Spain, the buyer must pay Value Added Tax (VAT), which amounts to 10% of the purchase price, and Stamp Duties (1,25%).

All prices are without VAT and taxes.

Final steps

All names on contracts related to the property will need to be updated when you become a new owner. This includes all utilities (water, electricity, etc.), council tax, rubbish tax, and community fees. A Bank account in Spain is needed to ensure all payments are made. It is possible to set up direct debits for all. A bank account in Spain is required to ensure all payments go through. We are ready to help you open a bank account if you need us to.
